Srinagar, May 26: The Central Administrative Tribunal (CAT) in Srinagar Tuesday directed the authorities to consider, with a humanitarian view, a teacher’s plea over her transfer given her “family way” and health conditions. In response to the teacher’s plea seeking intervention for her transfer from Baramulla to Srinagar, a bench of Judicial Member, M S Latif, at the very threshold in its order highlighted that “the most cherished desire of a woman is to be a mother.” The teacher, a resident of Peer Bagh, Srinagar, had petitioned the tribunal with the contention that preservation of family life is an incident of Article 21, by relying on a related Supreme Court decision. The tribunal asked the authorities to treat the petition the teacher had filed before it as a “representation” and decide the same, keeping in view her family way and health conditions.
